Plaintiff brought this action to recover the sum of ten thousand dollars damage for injuries sustained, he alleges, through the negligence of the employees of the defendant company, in June, 1898, at about 9 o’clock in the morning. The defendant is the owner of a line of ears operating on St. Charles avenue, and has two tracks. The distance between the two rails, or the guage, is five feet, and the distance between the two tracks is eight feet.
