This is an action brought by Charles R. Allen, as plaintiff, against the Western Union Telegraph Company, as defendant, to recover damages for failure to deliver a telegram sent to Allen at Hawarden, Iowa, by one Moore from Pauls Valley, Okla. The plaintiff recovered judgment in the trial court, and the defendant brings the cause to this court by petition in error.
