Defendant was charged in one count with grand theft of a Cadillac automobile; in a second count with burglary with intent to commit theft; in a third count with violating section 12021 of the Penal Code in possessing a firearm (22 caliber automatic) having been previously convicted of a felony; and with a prior conviction of a felony (Dyer Act, title 18 U.S.C.A. §2312) and having served a term therefor in a penal institution.
