Appeal from an order of the Supreme Court at Special Term (Mercure, J.), entered March 19, 1985 in Warren County, which, inter alia, denied plaintiff’s motion to restore this action to the Trial Calendar and granted defendant’s cross motion to dismiss the complaint with prejudice.
In June 1978, plaintiff contracted with defendant for repairs to the roof of plaintiff’s Lake George house, located in Warren County. The work was finished in October 1978.
