—In a proceeding pursuant to CPLR article 78 to review a determination of the respondent New York State Department of Environmental Conservation, dated July 13,1995, granting a tidal wetlands permit to Robert A. Parsons, the petitioner appeals from a judgment of the Supreme Court, Suffolk County (Mullen, J.), dated February *50315, 1996, which denied the petition and dismissed the proceeding.

Ordered that the judgment is affirmed, with costs.
