Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review determinations of respondent Commissioner of Correctional Services which found petitioner guilty of violating certain prison disciplinary rules.

On April 27, 2002, petitioner was scheduled to work at the law library, but was not released from his cell at the appropriate time.
