The defendant was charged by information with the crime of manslaughter, in that, while driving an automobile and under the influence of intoxicating liquor, and proceeding at an unlawful rate of speed and on the wrong side of the road, he ran over and killed one George Boulden. The trial was to the court and a jury, and resulted in a verdict of guilty. Motions in arrest of judgment and for new trial were made and overruled, and from the judgment and sentence the defendant appeals.
