Associate Justice.—This case was tried below on the following agreed statement of facts: -
“Eugenia Epperson was a minor on and before January 1, 1894, and her guardians were H. McICay and his wife, Fitzie McKay, who were appointed by the County Court of Marion County, Texas, the said Fitzie McKay being the mother of said minor by a former marriage, and the estate of the minor was administered in Marion County, Texas, and the said minor married Henry D.
