Judgment unanimously reversed on the law and matter remanded for further proceedings consistent with the opinion of this court.
On October 8, 1982, defendant pleaded guilty to menacing and was sentenced to a conditional discharge and a fine of $250 or 90 days in jail. On November 12, 1982, defen*1021dant pleaded guilty to disorderly conduct and was sentenced to a conditional discharge and a fine of $100 or 10 days in jail.
