Petitioner was convicted by general court-martial of conduct unbecoming an officer and a gentleman in violation of Article of War 95, 10 U.S.C. § 1567. He was found guilty on June 6, 1951, and was sentenced to be dismissed from the service. The substance of the charge was that he had cheated on a written examination by wrongfully and dishonorably submitting, as his own solutions, answers not his own.
