ERVIN, Judge.

Defendants Curtis Cochran, Sheriff of Swain County, and Western Surety Company appeal from an order denying Defendants’ summary judgment motion. On appeal, Defendants argue that the trial court erred by failing to conclude that there was no genuine issue of material fact and that Defendants were entitled to judgment in their favor as a matter of law on governmental immunity grounds. After careful consideration of Defendants’ challenges to the trial court’s judgment in light of the *185record and the applicable law, we conclude that the trial court’s order should be affirmed.
