Derrick E. Tierney appeals from his convictions for one count of obstructing a police officer, a violation of Neb. Rev. Stat. § 28-906 (Reissue 1995), and one count of possession of a controlled substance, a violation of Neb. Rev. Stat. § 28-416 (Reissue 1995). Summarized, Tierney contends that the court erred in overruling his motion to suppress and in imposing excessive sentences. Because the arresting officer did not have reasonable suspicion to conduct a pat-down search of Tierney, we now reverse Tierney’s conviction for possession of a controlled substance under § 28-416…
