In this direct criminal appeal, three co-defendants — Thomas Pacchioli, Robert Andrei, and Thomas Kennedy — seek to overturn their criminal convictions stemming from a “pay-to-play” conspiracy in which they paid kickbacks to several hospital facility managers in order to obtain lucrative service contracts with those hospitals. The most novel issue presented by this case concerns when the statute of limitations begins to run for a violation of 18 U.S.C. § 666(a)(2).
