PITTS, Chief Justice.

This is an independent suit filed by ap-pellees against appellants seeking to set aside and annul the will of Ezekiel Bell after it was admitted to probate, which, after a hearing had on March 16, 1949, resulted in a judgment of the County Court sustaining, in effect, the will and the probate thereof, from which judgment appel-lees perfected an .appeal to the District Court. Thereafter appellants filed in the District Court a motion to dismiss the appeal and a verified plea in abatement seeking a dismissal of the appeal on the alleged grounds that appellees had abandoned…
