This case came before the Supreme Court on the appeal of the town of Middletown (town or Middletown) from the entry of partial summary judgment in two separate actions brought by several commercial property owners, including Newport Court Club Associates, a health club; Melbro, Inc., a mobile-home park; and George and Janet Silvia, operators of a laundromat (collectively plaintiffs).
