This is an inverse condemnation case. On the second trial of the case the jury returned a verdict of $27,000 in favor of the plaintiff West against the defendant City of Atlanta by reason of damages to plaintiffs property. The damages were sustained as a result of a previous condemnation of property adjacent to plaintiffs property on behalf of the Metropolitan Atlanta Rapid Transit Authority (MARTA) whereby a railroad spur track serving plaintiffs property was severed thereby permanently depriving the plaintiff of the right to ship building materials and other…
