Wilson, Judge:

This is an action filed by an American manufacturer under section 516 (b) of the Tariff Act of 1930, as amended. The eligibility of the Pittsburgh Plate Glass Company, the plaintiff, to file this action has not been questioned. When the case was first called for trial in Miami, Fla., the importer, Bellhouse Louver Windows, which will be referred to hereinafter as “the party in interest” made a motion to dismiss the complaint upon the ground that it was not filed within the time required by law.
