The plaintiffs are two savings and loan associations, doing business at Galesburg, Illinois, in this district. The defendant is a title insurance company, incorporated under the laws of the- State of California. The cause is now before the court on cross-mo*1384tions for summary judgment. It is necessary, at the outset, to frame a proper context of the complaint to see both what the suit is and is not.
