The dispositive issue in this certified appeal is whether the Appellate Court properly concluded that the defendant, Noel Bermudez, was deprived of a fair trial due to prosecutorial misconduct and the trial court’s overemphasis of the charge of manslaughter in the first degree in its instructions to the jury.
