In this action, the plaintiff, Specialized Carriers & Rigging Association (SC & RA), a non-profit incorporated association composed of haulers of heavy and oversized machinery, equipment, building materials and supplies, challenges under both the Supremacy 1 and the Commerce Clauses 2 the constitutionality of a 1985 amendment of Section 46.1-267 of the Code of Virginia, which broadened the scope of that section to require amber flashing lights, visible for at least 500 feet, on any motor vehicle engaged in “either escorting, or towing overdimensional materials,…
