Matteson v. Walsh

This is a cross appeal from a Superior Court judgment that entered following a bench trial on an action for waste to real property in the town of Chatham (town). The plaintiff, Elizabeth Gay Matteson, brought this action as a holder of a *403remainder interest against her brother, Robert L. Walsh, a life tenant. The judge concluded that Walsh’s failure to pay the property taxes constituted waste, essentially because his failure to do so endangered the remaindermen’s interest.
