Appeal from the Circuit Court of the United States for the Eastern District of Pennsylvania. Suit in equity by Charles Russell, ancillary administrator of the estate of Charles F. McCay, deceased, against the Girard Trust Company. Decree for complainant (171 Fed. 161), and defendant appeals.

LANNING, Circuit Judge.

In this case the court is required to decide whether a certain fund, now in the possession of the Girard Trust Company of Philadelphia, is held by it as a charitable trust for the benefit of the state of Pennsylvania, or as a resulting trust in favor of Charles Russell, ancillary administrator of the estate of Charles F. McCay, deceased. The decision must be controlled by our construction of a written agreement, dated December 18, 1848, signed and sealed by the Girard Trust Company, of the first part, and Charles F.
