This litigation arises out of the crash of a small aircraft near Augusta, Kansas, on May 24, 1998. The plane, a twin-engine Cessna 310R, was piloted by plaintiff Robert H. Souders, Sr. Plaintiffs Richard Bie-berle, Sherrie Bieberle, and Robert H. Souders, Jr., were passengers on the plane. Pilot Souders took off with his passengers at about 3:15 a.m. on the morning of May 24th from the Augusta (Kansas) Municipal Airport.
