This ease was certified to this court by the St. Louis Court of Appeals, one of *189the judges dissenting from the opinion on the ground that, in his judgment, it is in conflict with the decision of this court in the case of Wolcott v. Lawrence County, 26 Mo. 277. We think there is no such conflict. The following majority opinion of the Court of Appeals, written by Goode, J., is approved and adopted as the opinion of this court, and the judgment is affirmed.
