The appeal is from an order sustaining appellee’s motion for summary judgment under Rule 56 of the Federal Rules of Civil Procedure, 28 U.S.C.A. following section 723c.

Appellant sued for libel on account of the publication of a newspaper article, set forth below, 1 which he says falsely stated that he had been disbarred. Appellee admits the publication, but says the statement is true and that the District Court and we have judicial knowledge that it is so from previous judicial proceedings here and below.
