The plaintiff, Otto Stein, administrator of the estate of Evelyn Stein, deceased, filed his declaration and complains of the West Chicago Parle Commissioners of a plea of trespass on the case. The declaration consists of two counts. The first count charges that on, to wit, the 31st day of October, 1925, the defendant, under the authority vested in it by the laws of the State of Illinois, had control, management and supervision of a park system in the town of West Chicago, a part of the city of Chicago, and particularly that part known as Douglas Park; that the defendant erected and maintained…
