OPINION

WIDENER, Chief Judge.

Plaintiff, a citizen of Michigan, claims $100,000.00 in damages against the defendant, Town of Coeburn, Virginia, as well as $100,000.00 in damages against defendants Markham and Lambert and $100,000.00 in damages against defendant Mullins. The plaintiff’s complaint alleges that the defendant, Town of Coeburn, Virginia, employed defendant W. C. Lambert as its Mayor, defendant Harold Markham as its Police Chief and defendant J. E.
