After the legislature enacted subchapter V of the Texas Health & Safety Code, entitled, “Fee on Cigarettes and Cigarette Tobacco Products Manufactured by Certain Companies,” appellees Texas Small Tobacco Coalition and Global Tobacco, Inc.
