Order, Supreme Court, New York County (Jane Solomon, J.), entered February 13, 2002, which granted defendant’s motion to dismiss the complaint, unanimously reversed, on the law, without costs, and upon searching the record, summary judgment granted to plaintiff on the issue of defendant’s liability for rent payments under the lease, and the matter remanded for further proceedings.
