Appeal and cross appeal from an order of the Supreme Court, Erie County (Christopher J. Burns, J.), entered February 16, 2010 in a medical malpractice action. The order denied that part of plaintiffs motion to strike defendants’ joint answer and granted that part of plaintiffs motion for a new trial with respect to defendant Ronald G. Basalyga, M.D.
It is hereby ordered that said appeal is dismissed (see Loafin’ Tree Rest, v Pardi [appeal No. 1], 162 AD2d 985 [1990]) and the order is otherwise affirmed without costs.
