MR. CHIEF JUSTICE HARRISON:

This is a habeas corpus proceeding instituted in the district court of Yellowstone County, Montana. The case involves the question of custody of the child, Ronald Douglas Burns, who was born on July 26, 1949, and at present is approximately seven and one-half years of age. Relator, Winfred H. Burns, is the boy’s father. The respondents, Victor D. Groshelle and Ruth M. Groshelle, have kept and cared for the child since April *311, 1952.
