OPINION
ENSLEN, District Judge.
This action comes before the Court on Defendant’s Motion to Dismiss the Complaint pursuant to Rule 12(b)(1), Federal Rules of Civil Procedure (FRCP), for lack of subject matter jurisdiction.
In reviewing Defendant’s motion, the Court’s inquiry at this point in the proceeding is limited to whether or not the challenged pleading sets forth allegations sufficient to show that the Court has subject matter jurisdiction in the case.
