REED, Judge.

In this appeal we are confronted with several problems involving the law of contracts. The plaintiff appeals from the action of the circuit court by which a verdict in his favor in the amount of $14,197.50 was set aside upon the defendant’s motion for judgment n. o. v.; a judgment was entered dismissing the plaintiff’s claim; $2,-697.50 had been paid by the defendant on a confessed judgment. We have concluded that the decision of the trial judge was partly correct but that the plaintiff should not have been deprived of the entire judgment in his favor; a retrial is necessary;…
