The respondent was convicted of manslaughter upon trial under an information charging him with having killed and murdered one Edward Winters. There was evidence to the effect that on the day in question respondent, who was a soldier in the United States army, had been downtown in the afternoon drinking at various saloons. Early in the evening he had hired a rig from Louis Belanger, and was driving it. He drove up to the Montreal House and stopped, and there met Winters. A witness testified:
