THIS CAUSE came on for hearing with notice to all parties in interest to consider a Motion filed by the Defendant, Howard Jay Nemovitz, a/k/a Howard Nemovitz (Debtor) to dismiss the five-Count Complaint filed by Donald W. Fields (Plaintiff). The first three Counts of the Complaint are based on 11 U.S.C. § 523(a)(2)(A), Count IV is based on 11 U.S.C. § 523(a)(6), and Count V is based on the Racketeer Influenced and Corrupt Organizations Act (RICO), 18 U.S.C. § 1961 et seq.
