*764In an action to recover damages for personal injuries, etc., the defendants M.A.C. Design Corp. and Ali Syed appeal from an order of the Supreme Court, Kings County (Jacobson, J.), dated December 4, 2007, which denied their motion to dismiss the complaint insofar as asserted against the defendant M.A.C. Design Corp. on the ground that it was barred by a release pursuant to CPLR 3211 (a) (5) and to dismiss the complaint insofar as asserted against the defendant Ali Syed on the ground that it fails to state a cause of action pursuant to CPLR 3211 (a) (7).
