Defendant, Marty Glenn Stover, was charged by information with the crimes of burglary, theft and resisting or obstructing peace officers. The burglary and theft charges were dismissed prior to trial. A jury in the circuit court of Champaign County found defendant guilty of the offense of resisting or obstructing a peace officer in violation of section 31 — 1 of the Criminal Code of 1961 (Ill. Rev. Stat. 1979, ch. 38, par. 31—1). The appellate court reversed and remanded for a new trial (92 Ill. App. 3d 542), holding that a defense witness, who is a former codefendant, was improperly impeached…
