OPINION
FAY, Chief Justice.
This is an appeal from a judgment of conviction rendered by a jury in Superior Court finding the defendant guilty of having committed assault with a dangerous weapon in violation of G.L. 1956 (1981 Reenactment) § 11-5-2, as amended by P.L. 1981, ch. 76, § 1. The defendant was found not guilty on charges of kidnaping. A motion for new trial was denied by the trial justice and the defendant now appeals from that ruling as well as the denial of the defendant’s motion to suppress evidence as the fruit of an illegal arrest; from the refusal of the court to pass the case…
