Before me in this in rem proceeding under the recently enacted Anticybers-quatting Consumer Protection Act (ACPA) are plaintiff BroadBridge Media’s order to show cause for a preliminary injunction continuing the transfer of the domain name <hypercd.com> from Barry Henderson to plaintiff, earlier ordered on a TRO, and Henderson’s cross motion to dismiss for lack of jurisdiction or failure to state a claim.
