Comstock, J. —

The Elwood Iron Works, manufacturers of steam radiators at Elwood, Indiana, by *185Jacob Loomis, receiver, brought this action to recover on an account for steam radiators furnished to Stevens & Bedwards, a firm composed of Andrew W. Stevens and William Bedwards; pending suit in the circuit court, and before trial, Bedwards died. Andrew W. Stevens and William Bedwards were plumbers, located at Logansport; they entered into a contract with A. 0. Barnett to do all the plumbing and steam' fitting in his new hotel, which he was erecting at Logansport, Indiana. Stevens & Bedwards…
