HAWKINS, Judge.

Appellant is under conviction for the murder of D. N. Oden, his punishment being assessed at confinement in the penitentiary for 10 years.

It is contended that the court was in error in submitting the issue of murder, appellant asserting that the evidence at most would support a conviction, for manslaughter only. Deceased was a physician living about three miles from the home of appellant.
