In a two-count information, the defendant was charged, in the first count, with possession of heroin with intent to sell in violation of General Statutes § 19-480 (a), and, in the second count, with possession of heroin in violation of General Statutes § 19-481 (a). Upon a plea of guilty to the second count, the defendant was sentenced to a term of not less than two or more than five years, and the state nolled the first count. The defendant has appealed from the judgment rendered, assigning as error the court’s denial of his motion to withdraw his plea of guilty.
