Plaintiff recovered, a judgment against the defendant for $13,937 fbr personal injuries claimed to have been sustained on account of the defendant’s negligence. Defendant has appealed.
The defendant owns and operates by electric power a street railway system, a part' of which is laid upon Military avenue in the suburbs of the city of Omaha, and at, the point where the accident occurred the tracks run in what may be termed an east and west direction.
