It is contended that the Miners’ Examining Board statute is unconstitutional by reason of the fact that the county judges of the State cannot be constitutionally invested with the power to appoint the members of the miners’ examining boards provided for by that statute, it being the view of the plaintiff in efror that the members of said boards are State officers, and that a State officer can only be appointed by the Governor.'
