This is an appeal by the plaintiff from a judgment of the circuit court based upon a directed verdict. The action out of which the challenged judgment arose was predicated upon averments that the plaintiff, while a paying patient in the defendant’s hospital, was injured through the negligence of a nurse in the defendant’s employ who, the plaintiff alleges, the defendant knew was incompetent.
