MEMORANDUM OPINION AND ORDER

MOODY, District Judge.

This matter is before the court on the plaintiffs’ untimely “Motion to Strike Defendants’ Non-Party Defense,” filed with leave of court after the final pretrial conference. The defendants responded, and the plaintiffs replied.

I. BACKGROUND

On June 13, 1988, one Joan J. Pritt (“Pritt”) drove a car in which plaintiff John Herman Rockrohr, Jr. (“Rockrohr”) rode as a passenger. The car collided with a train at a railway crossing.
