The plaintiffs insist, that the act of 1816 is a contract within the meaning of that clause of the constitution of the United States, which declares, that no state shall pass a law impairing the obligation of contracts : that it is a contract executed — a grant, perfect and complete in itself, and which has been accepted by the plaintiffs ; or that it is a valid executory contract, supported by a sufficient consideration ; or, from the character of the contracting parties and the form and object of the contract, is obligatory without any consideration in fact.
