McCLENDON, Chief Justice.

This is a suit to recover title to and possession of 50 acres of land in Milam County, brought by appellee, Steck (The Steck Company, a corporation), against appellant, S. H. McDermott. In a. trial to the court without a jury, Steck recovered as prayed. McDermott has appealed.

The facts are without dispute. Mrs. Witliff is common source of title. April 26, 1937, Steck recovered a personal judgment against her for $94.51, in a justice court in Travis County. An abstract of this judgment was filed, recorded, and (as noted below) indexed in the judgment records of Miiam…
