Alberti was incarcerated in Allegheny County following a verdict of the Coroner’s Jury that he be held to await the action of the Grand Jury on a charge of murder. He thereupon filed in the Common Pleas Court a petition for a writ of habeas corpus, asking *400that he be admitted to bail. At the hearing upon this petition the Commonwealth offered in evidence the record of the proceedings before the Coroner. Upon consideration of such record the Court admitted the relator to bail, and from that Order the District Attorney has appealed.
