MEMORANDUM OPINION GRANTING DEFENDANTS’ MOTION FOR SUMMARY JUDGMENT

SENTER, Chief Judge.

This cause is before the court on the motion of the defendants for summary judg ment. The court previously entered an order which granted a motion to dismiss as to Austin Stanciel in his individual capacity and denied the motion with regard to the City of Greenwood and Austin Stanciel in his official capacity.
